It is
important that you understand the differences between a
professional who represents a seller, a professional who
represents a buyer, and one who represents both.
-
Seller's Agent - A
Seller's Agent has a listing agreement to represent
the seller's interests. A Seller's Agent may provide information to help
the buyer, but the interests of the seller must come first.
Including not disclosing specific information a seller does
not want the buyer to know.
-
Buyer's Agent - A
Buyer's Agent has an agreement to represent the buyer. A Buyer's Agent
may
assist the seller, but does not represent the seller. The
Buyer's Agent must place the interests of the buyer first. A
Buyer's Agent must
disclose any related information to the buyer.
-
Dual Agent - Dual
agency takes place when a real estate professional represents both
the seller and the buyer. Also, when the Seller's Agent works for the same
realty company as the
Buyer's Agent, a dual agent occurs. In the case of dual agency, the
agents
duties are more limited and potential for conflict of
interest exists. When a dual agency is involved in a
real estate transaction, a "transaction broker" or
"intermediary" may also be involved.
